(4)(b) Students suspected of having a disability must be evaluated within a period of time not to exceed sixty (60) school days of which the student is in attendance or for pre-kindergarten (PreK) children, not to exceed sixty (60) school days.Districts must ensure that all assessments needed to complete the evaluation are administered within the 60-day timeline and that an eligibility staffing meeting to determine whether the student is an eligible student with a disability is conducted with no undue delay.
However, the intent of the timeline is to ensure that appropriate special education and related services are provided to a student with a disability with no undue delay.
